There are 13 appellate courts that sit below the U.S. Supreme Court, and they are called the U.S. Courts of Appeals. The 94 federal judicial districts are organized into 12 regional circuits, each of which has a court of appeals. The appellate court’s task is to determine whether or not the law was applied correctly in the trial court. Appeals courts consist of three judges and do not use a jury. A court of appeals hears challenges to district court decisions from courts located within its circuit, as well as appeals from decisions of federal administrative agencies. The decisions of the Board of Immigration Appeals can only be appealed to the US Appellate courts and NOT District Courts. The US Appellate Court with jurisdiction on your case depends on where your

The Federal Rules of Appellate Procedure govern procedure in the United States courts of appeals. Local rules governing practice and procedure must be consistent with both Acts of Congress and the Federal Rules of Practice and Procedure and may only be prescribed after notice and an opportunity for public comment. A courts authority to prescribe local rules is governed by both statute and the Federal Rules of Practice and Procedure. See 28 U.S.C. §§ 2071(a)-(b); Fed. R. App. P. 47; Fed. R. Bankr. P. 9029; Fed. R. Civ. P. 83; Fed. R. Crim. P. 57. Each Appellate Court has adopted its own
local rules and directions for parties, litigants, and counsel to regulate practice before the court.
